ICCAuctions Terms and Conditions

GENERAL

This website is sponsored by ICCAuctions, LLC. The intent is to provide a forum for interested sellers and buyers to sell and purchase corkscrews and related items.   There are two different formats – an online auction with sales held three times each year; and a year around sale of fixed price (Buy Now) items. 

Auction Format

The auction site will not knowingly allow new or reproduction items. Classic replicas are allowed if numbered and clearly identified. All items must be approved for sale by the auction administrators.  Every effort will be made by the administrators to allow only genuine pieces.  However, it is impossible to identify all problem pieces from a digital picture. ICCAuctions does not guarantee the authenticity of any items. Most of the items listed are vintage or antique so they may no longer perform in accord with their purpose when made and ICCAuctions makes no express or implied warranties and no warranties of fitness for a particular purpose.

Fixed Price Format (Buy Now) 

Items listed in the fixed price sale are not approved by auction administrators.   All sellers in the fixed price sale are approved by sale administrators based on experience in the auction format and or other substantiating criteria.  However, auction administrators have the right to remove any lots they consider inappropriate for the sale.

The details outlined below provide the terms and conditions applicable to buyers and sellers participating in the either the auction format or fixed price format.

LIABILITY

Any disputes arising from a transaction or failure to complete a transaction shall be exclusively between the buyer and the seller.  It is the intent of ICCAuctions to provide a venue for buyers and sellers and assumes no liability for any damages caused to buyers or sellers due to failure to complete a transaction or failure of seller to refund buyer’s payment. If a seller refuses or is unable to complete a transaction, any money paid by the buyer shall be returned in full.   

ICCAuctions assumes no liability with respect to goods sold or for any loss during shipment.

Most of the items listed are vintage or antique so they may no longer perform in accord with their purpose when made.  ICCAuctions makes no express or implied warranties and no warranties of fitness for a particular purpose.

TRADEMARKS

The term “CollectorCorkscrews ™” is a trademark owned by ICCAuctions,  LLC and may not be used or copied without the express written permission of ICCAuctions, LLC.    In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through this website are trademarks or trade dress of CollectorCorkscrews ™  in the U.S. and other countries.


TERMS AND CONDITIONS FOR BUYERS

Registration - Prior to participating in this auction buyers must:

a) Acknowledge that they have read and agree to the auction terms and conditions by checking the appropriate box at the end of the terms and conditions section and submitting this to the ICCAuctions auction host site.

b) Register as a participating buyer. (Please see tab for registration information required.)

c) Registrants are not allowed to create more than one account.

Auction format

Bid Increments -All lots will use standard bid increments based on the value of the lot. Bid increments will be as follows:

$100 - $250  $10.00

$251 - $500  $25.00

$501 - $1000  $50.00

$1001 - $5000  $100.00

$5001 - $10,000  $250.00

OVER  $10,000  $500.00

Bidding  - Bids may be submitted at any time while the listing is active. Proxy bids will be entered in accordance with the appropriate bid increment. Any bids submitted during the last 5 minutes of the auction will extend the auction closing for 5 minutes from the time of that bid. If no additional bids are received in this extended period the auction will close and the high bidder will be judged the winner. This process will be repeated until no further bids are received in the final 5 minute period. At this point the high bidder will be judged the winner. This anti-sniping provision allows auctions to run until all bidding has ended – similar to a traditional auction house. The bid history for all items will be visible during the sale (including those below the reserve) to all registered users; after the sale only the buyer and seller will be able to see the bid history.

Tying bids - In the event that there are tying bids the first bid received takes precedence.

Bid Retractions - must be processed by the auction Administrator. Bids cannot be retracted within 48 hours of the auction close. To reach the Administrator go to "Contact" at the bottom of any auction page.

“Shill bidding” is prohibited and ICCAuctions will suspend any user found to be shill bidding. "Shill bidding" is any bidding on an item you do not intend to buy including bidding on items you are selling, whether made directly by you or someone on your behalf.

Invoicing -Winning bidders will be invoiced by the seller at the conclusion of the auction. The invoice will show the final bid price, shipping costs and insurance costs (if applicable). The invoice will also show payment terms accepted by the seller.

Invoices will be provided by the seller within 3 business days of the close of the auction.

Binding Contract – Whether in the auction or the fixed price format, a sale is a binding, legal contract between the buyer and the seller.  A failure of the buyer to pay or the seller to deliver the item(s) purchased may lead to suspension by ICCAuctions.

Payments - The buyer is required to complete payment for the item within 7 business days from receipt of the invoice, or to notify the seller that funds have been dispatched if paying by check or money order.

Non Paying Bidders - Non-paying bidders will be barred from bidding on future auctions on this site.

Returns – A buyer may return an item to the seller if the item is not as described, is proved not to be authentic, exhibits undisclosed repairs or condition problems not clearly defined in the listing or photographs.

All returns must be insured, packaged and returned in the condition received.

The buyer must notify the seller on receipt of the item that there is a problem with the lot. The lot must be returned within 30 days of the close of the sale for U.S. domestic customers and 45 days of the close of the sale for International customers.

The agreement to return an item is a contract solely between buyer and seller.  ICCAuctions does not guarantee the performance of buyer or seller and does not assume any liability for any breach or failure to perform by either buyer or seller to perform the contract.  

Refunds – Refunds will be limited to the final auction price paid for the lot. Shipping and insurance costs will not be refundable.

Items over $5000 – Buyers for auctions closing with a value over $5000 are required to maintain proof of agreement with the seller describing who is responsible for lost or damaged shipments. ICCAuctions assumes no liability for any damages or losses incurred.

Fixed Price Format

WANTED: Registered parties  can use the BUY NOW section to express an interest in acquiring a corkscrew, corkscrew part or other wine related item. To do this the heading must start with the word "WANTED".Users of this facility agree that such WANTED listings are merely an expression of interest not an offer to purchase or sell and the user submitting the WANTED listing reserves all discretion to decide whether to purchase any particular item and at what price,terms and conditions. ICCAuctions does not review,vet or approve the genuineness or condition of any item. All communications and any agreements in respect of WANTED listings are private between the parties and ICCAuctions has no responsibility,involvement or liability for or arising from the transaction

Users listing in the WANTED category should include in the description section the statement "In accordance with the TERMS AND CONDITIONS, this is merely an expression of interest not an offer to purchase or sell". The price in the listing is merely a starting place for discussion.

ICCAuctions charges no fees in relation to WANTED listings or any resulting transactions but reserves the right,without explanation or notice,to remove any WANTED listing.

TERMS AND CONDITIONS FOR SELLERS

Auction format

Registration - Prior to participating in this auction sellers must:

a) Acknowledge that they have read and agree to the auction terms and conditions by checking the appropriate box at the end of the terms and conditions section and submitting this to the ICCAuctions host site.

b) Register as a participating seller. (Please see tab for registration information required).

c) Registrants are not allowed to create more than one account.

Auction Lots -All auction lots listed must have a Starting Price of at least $100.00. (Lots with multiple pieces are permitted as long as this minimum value is maintained).

Listings - The seller is responsible for listing the item offered for sale. As part of this listing process the seller agrees to accurately describe the item using the following guidelines:

(a) List appropriate details on the piece being offered for sale including marks, patent dates, registration marks, etc.

(b) Providing details on the condition of the item noting areas of wear or damage not easily visible in the pictures provided with the listing.

(c) Provide details of any repairs or parts that are not original.

(d) Provide up to a maximum of four photographs of appropriate quality that accurately portray the item being offered for sale.

(e) Only original antiques or numbered classics are allowed. ICCAuctions reserves the right to reject lots without explanation.

The auction site will open for listings 30 days prior to the end of the auction. No listings will be permitted in the period 7 days prior to the auction close.

Returns – A buyer may return an item to the seller if the item is not as described, is proved not to be authentic, exhibits undisclosed repairs or condition problems not clearly defined in the listing or photographs.

All returns must be insured, packaged and returned in the condition received.

Listing Assistance -The ICCAuctions committee will, if requested, assist sellers in providing appropriate additional information regarding the listing process only. However, any information provided by ICCAuctions is not and cannot be considered as endorsing or supporting claims made by the seller. Sellers are fully responsible for auction content and descriptions including condition and authenticity. ICCAuctions committee members will not provide advice on reserves or auction value.  Most of the items listed are vintage or antique so they may no longer perform in accord with their purpose when made.  ICCAuctions makes no express or implied warranties and no warranties of fitness for a particular purpose.

Reserves - The seller may at their discretion place an appropriate reserve on an item when completing their listing. All reserves are confidential and visible only to the seller. ICCAuctions administrators do not have access to this information. It is possible for a seller to lower the reserve during the auction down to a minimum of one bid increment above the high bid.

Terminating Listing - In listing an item sellers are encouraged not to terminate a listing during the auction process. (Sellers who terminate listings may be barred from participating in future auctions.). This provision is intended to allow all pieces being offered to reach their market value potential and provide a level field for all potential bidders. Requests to terminate a listing must be made at least 48 hours before the auction ends.

“Shill bidding” is prohibited and ICCAuctions will suspend any user found to be shill bidding. "Shill bidding" is any bidding on an item you do not intend to buy including bidding on items you are selling, whether made directly by you or someone on your behalf.

Fees - There are no listing fees - if your item does not sell there is no cost to you. All sales have a 2.8% sellers fee up to $5000; and for items over $5000, $125 plus 1.8% of the amount over $5000 payable to ICCAuctions. There are no buyers fees. Sellers who do not pay fees within 30 days of the last sale will be assessed a 10% penalty. If fees and penalty not paid within 45 days, the seller will be suspended.

Post auction sales: Any seller’s piece failing to sell at auction and is thereafter sold within 30 days to a bidder or other auction registrant must be reported by the seller to ICCAuctions. Failure to do so may result in suspension of their account. NOTE, to report a sale, sellers should go to My ICCAuctions>Listings>Unsuccessful and the button REPORT SALE OF THIS ITEM.

Payment terms - Sellers may determine what payment terms they accept, but the acceptance of Paypal payments is highly recommended to facilitate bidding by international customers. Paypal also provides additional protections for buyers and sellers and facilitates the timely exchange of funds at the conclusion of the auction.

Items over $5000 – Sellers for auctions closing with a value over $5000 are required to maintain proof of agreement with the buyer describing who is responsible for lost or damaged shipments. ICCAuctions assumes no liability for any damages or losses incurred.

Shipping - Sellers are asked to ship all items within a maximum of five business days after payment is received.

Exchange rates- All listings will be shown in U.S. dollars. Sellers may also list in Euros or GBP. Currency conversions will be updated daily. Sellers will be asked to specify currency required for payment as part of the listing process.

d) All potential sellers on the fixed price format must apply for approval by the sale administrators.  This can be done by email or via the “Request Approval to Sell” button in My Buy Now>Account>Account details.   Approvals are based on performance in the auction format and or other substantiating criteria.  All decisions by the administrators are final.
